I purchased a flat in a residential project in North Delhi back in 2021 on the basis of a builder's promise of possession within thirty six months. It has now been over four years and the project is nowhere close to completion. The builder keeps sending vague update emails about construction delays without giving any firm possession date. My entire life savings went into this flat and I am simultaneously paying EMIs on the home loan and rent for the place I am currently living in.
I have recently learned that several other buyers in the same project are facing the same situation and some of them are considering filing a group complaint before the consumer forum. I have also been told that RERA is an option but I am not sure whether the consumer court or RERA would be the better route for my specific situation given that I want compensation for the delay in addition to possession or a full refund.
The builder's agreement has a clause that tries to limit compensation for delays to a very small amount per month which I believe is completely inadequate for the actual financial losses I have suffered including the double burden of EMI and rent for over two years. I have been told that consumer courts in Delhi regularly award much higher compensation than what is specified in such clauses when the delay is clearly the builder's fault. I am looking for guidance on how to find the best lawyer in Delhi who handles builder disputes before the consumer court and RERA simultaneously. What are the strongest grounds for my complaint? Can I claim compensation beyond what the agreement specifies? And how long do builder cases typically take before Delhi's consumer forums?
